Deposit and Sales Agreement:
After careful screening I will put interested parties on a waiting list. If you put a deposit on a
SHOW/BREEDING POTENTIAL Puppy/Dog and the bite, testicles or knees go off before leaving
my home your deposit will go towards a future litter. No refunds of any deposit or purchase
price will be given at any time. Deposits taken on pet quality pups WILL NOT transfer to
another litter. Buyer further understands that the technology does not exist to predetermine
the genetic outcome of any breeding as respect to health, conformation, temperament, or
performance ability. All pups sold show/breeding POTENTIAL are not guaranteed to be show or
breeding quality at an adult age unless they are sold AS ADULTS. With that being said, no-one
can really determine if a pup is worthy of breeding or showing until at least 6 months to 1 year
of age. Show potential is just that... POTENTIAL!
I will take your deposit to hold your puppy until it reaches its proper age to leave. Deposits
(Pet Quality or Show/Breeding POTENTIAL Quality) are taken on a first come first serve basis
for picking out your puppy. That means, whomever gives us the first deposit has the first pick
AFTER we have chosen any puppy we want may want to keep, (if any) or in case of my using
stud service, my obligation is to the breeder who's male I have used first for first pick of
Show/Breeding POTENTIAL quality pups. The single most important decision we can make for
our puppies is to determine whether each puppy is structurally sound enough to do what we
will ask of it in its lifetime. At 8 to 9 weeks of age we use the Hastings approach to evaluate
our pups to determine if they are show/breeding potential or pet quality based on health
screening and structural evaluation. If a person has a puppy deposit down for a pet quality
puppy and likes or chooses a show/breeding potential quality pup they will pay the show
quality price. If the deposit is for a pet quality dog they get first pick of all the pet
quality pups based on the timing of when their deposit was sent in.
The final payment for puppy must be paid in CASH ONLY when the puppy is picked up.
No puppy will leave my home until it is paid in full and if paid by check, the check must be paid
10 days in advance and the check must clear the bank before pup leaves. Money wire
transfers are acceptable previous to your picking up your puppy. 6% West Virginia sales tax
will be charged on all pups that are sold in the state of West Virginia. If you come to pick up
the puppy at my home and it is not delivered or shipped out of state then you are obligated to
pay sales tax. No checks, money orders or certified checks are accepted the day the puppy is
picked up.
We will email you a filled-out copy of this "Deposit and Sales Agreement" with all of Your
information filled in the blanks after we have received your filled-out copy of our "Puppy
Questionnaire" form (or other similar application information). We want you to know, in
advance, exactly what the terms and guarantees of the Puppy "Deposit and Sales Agreement"
are before you apply to buy one of our puppies.

PURCHASE PRICE:
My prices are not determined until the pups are evaluated for structure, soundness, health
and temperament at 8 weeks of age. In comparison, Biewer prices are considerably higher
than that of a Yorkshire Terrier. Biewer prices as in many breeds will range in price usually
based on pedigree, registrations, health checks, vaccination protocol, micro chipping,
markings on the body, and the estimated adult size... etc. In the USA, well bred, pet quality
Biewers usually range around $2500 and upwards yet, there are some adorable larger pet
quality Biewers whose price may be set a tad lower in hopes of finding the perfect forever
home. Show quality Biewers in the USA average around $3000 and upwards. Prices for pet
quality Yorkshire Terriers start at $1500 and go up depending on the bloodlines. Show
potential and breeding quality Yorkies are considerably higher. As with Biewers, there are
some adorable larger (pet) Yorkies whose price may be set lower in hopes of finding the
perfect forever home.
Part of the purchase price will be paid immediately with this Agreement as a Deposit to
guarantee that Seller will hold the Puppy for delivery to the Buyer on the below specified
delivery date.
The balance due ($________________), after crediting the deposit ($_______________), will be
paid in CASH at the time of delivery of the puppy to the Buyer. This purchase price does not
include any delivery charge (if any) which is calculated separately. 6% West Virginia Sales tax
will be added to the purchase price of the puppy unless it is delivered outside of the State of
West Virginia.
DEPOSIT (Surety of Action Deposit) in the amount of $______________ ($300.00 for Yorkshire
Terriers and $500.00 for the purchase price for Biewer Yorkshire Terrier a la Pom Pon or
Golddust Biewer Yorkshire Terrier) is required to hold this Puppy for the Buyer until date of
Delivery.
There are NO REFUNDS on deposits, unless otherwise agreed here in writing. Failure of the
Buyer to complete this purchase would subject Seller to lost opportunities to sell the Puppy
to another Buyer and retention of the Deposit is meant to compensate Seller for his possible
loss. This deposit signifies the intent on the part of the Buyer to follow through with the
Purchase of this Puppy. Please be certain of your intent to purchase before sending a
deposit as deposits are NON-REFUNDABLE.
The Seller reserves the right to void this transaction and refund the deposit if we learn of
any reason why Buyer might not be suitable for the puppy (i.e. Buyer is found to be an puppy
mill, animal abuser, violent person, representative of a Pet Store, representative of a
pharmaceutical research laboratory etc).
If the transaction is voided or if through some tragic accident the puppy were to die or
otherwise be seriously injured before it goes to its new home then of course, the deposit will
be returned to the Buyer; unless the Buyer wishes to apply the deposit to another puppy, if
one is available, or to a puppy from the next available litter.
PREFERRED DEPOSIT PAYMENT METHOD:
Our preferred method of payment is by money wire to my bank account from yours. Please
do not send cash. Checks are acceptable however, not on day of pickup. We will accept
cash only on day of pickup. We will send you an invoice via email.
You can print out this agreement, sign it, enclose a check for the deposit amount and mail it
to me. I will only give you my address via a phone call or email. We will not reserve a puppy
until the deposit payment and this agreement is received and cannot guarantee that a puppy
will be available at that time. If you choose to mail this agreement and no puppy is available
at the time we receive this Agreement and Deposit we will contact you and let you know
when the litter(s) is/are due.
DELIVERY OF PUPPY
we do ship puppies when they reach an appropriate age, never before 12 weeks of age!
There will be NO exceptions when it comes to young puppies. We do deliver puppies
personally to Washington Dulles International Airport or you can pick your puppy up at our
home.
DELIVERY DATE.
This puppy will be available for the Buyer to pick up personally at my home on or after this
date: _____________________. This date is based on our estimation of when the puppy will
be naturally weaned and ready to leave its Dam. Typically our puppies stay with their Dams at
an absolute minimum of 12 weeks of age. If the Buyer is not able to pick up the puppy on the
stated delivery date, we will be glad to continue caring for the puppy for a reasonable time-
limited to 30 days unless otherwise arranged, but we will add a charge of $2 per day for
boarding for every day after the scheduled pickup date.
DELIVERY CHARGE
If possible, Seller will be happy to meet the Buyer at some agreed in-between location. We
will charge
a delivery charge. Our charge for delivering this puppy to ____________ would be

This delivery charge is designed to pay for our gasoline and out of pocket expenses on a trip.
