Health Guarantee and Sales Contract

Buyer is to arrange a puppy health check by a qualified Veterinarian within 72 hours of
receiving the puppy to verify the puppy's good health.  Scan dated proof of the visit along
with results must be emailed it to me ASAP.  

During this initial exam, should your vet find this puppy unfit for sale, you must notify the breeder
within 24 hours of this exam, with the veterinary report of diagnosis.  Scan and email me the results.
The Buyer is responsible for returning the puppy and all papers (registration, guarantee, shot record
& written Veterinary diagnosis) at the Buyers cost if puppy is found to be unacceptable.  If a suitable
replacement puppy is not available, the full purchase price will be refunded upon the return of the
puppy.  

Failure to notify the seller within 24 hours of veterinarian’s certification of illness will result
in forfeiture of rights.

In case of death of the puppy/dog before the initial exam, the Buyer must submit a qualified
Veterinarian's necropsy report as to the cause of death. Death must be due to covered disease or
defect. Failure to have the initial vet check performed within 72 hours of receiving the puppy,
will void
this warranty
. The breeder may opt to perform a secondary necropsy with a Veterinarian of their
choice.

Buyer, by signing this contract, acknowledges that he/she is aware that there are health problems
that are not uncommon to the toy breeds. Some of these potential health problems are known to be
genetic, some are believed to have some genetic predisposition, and the cause of others is unknown
or is random in occurrence. Buyer further understands that the technology does not exist to
predetermine the genetic outcome of any breeding as respect to health, conformation, temperament,
or performance ability.

At no time will the breeder be responsible for any Vet bills incurred (for any reason) after the sale of
this puppy. The breeder's warranty is limited to a replacement puppy (if available) upon the immediate
return of the original puppy (uninjured and unharmed in any way), its registration and pedigree
papers, and a written diagnosis of the communicable disease or congenital defect that makes the
puppy unfit for sale. Not covered are internal or external parasites (worms, mite, flea, tick, coccidia,
giardia, fungus, ringworm), kennel cough, injury that occurred after the puppy left the breeders care,
allergies, heat exhaustion or hypoglycemia problems as these may be common in puppies and can be
treated.

Hypoglycemia is preventable with good care and feeding.   If the puppy has to be euthanized due to
humane reasons before the breeder can be notified, then a necropsy must be performed to verify
defect, or this guarantee will be considered void. Buyer understands that the following are not "life
threatening" and are NOT covered within this guarantee, hernia's, un-descended testicles and
abnormal bites. Because luxating patella's and collapsing trachea can be caused by injury as well,
they are not covered after the 72 hour initial Vet exam. Buyer understands that the replacement
option is only valid when health problems are life threatening and are attributed solely to a proven
hereditary problem and are not due to accident or injury.

Seller strongly urges on arrival of your pup to give a 1” strip of either Forti-Cal, Nutri-Cal or Karo
Syrup once a day for 1 to 2 weeks in the new home.  It is easy for pups to become stressed in a new
home and this will help to prevent hypoglycemia.  Hypoglycemia is defined as abnormally low blood
glucose (sugar) levels.  The brain requires sugar for normal function, and unlike many other organs,
the brain has a very limited ability to store glucose.  Stress, low body temperature, poor nutrition,
sudden change in feed, water and schedule patterns, infections, and premature birth may precipitate
the onset of hypoglycemia.  The signs and symptoms of hypoglycemia are similar regardless of the
cause.  These include lethargy, weakness, in-coordination, seizures, nervousness, tremors and
hunger.  Some puppies may only exhibit weakness or a wobbly gait.  In severe cases the puppy may
become unconscious.  By giving a quickly absorbed source of sugar (Forti-Cal or Nutri-Cal) by mouth
you may be able to control the symptoms.  If the pup is not treated it can result in death.  Make sure
your puppy has food and water at all times.

The Buyer has read the Hypoglycemia information the breeder has provided, including prevention,
symptoms and treatment. ___________________ (Buyers Initials)

Breeders/Sellers have, to the best of their knowledge and ability, made a good faith effort to
determine that the puppy and its dam and sire are free of inherited genetic disease. Notwithstanding
the efforts of Sellers, Buyer understands and acknowledges that Sellers can NOT predetermine the
outcome of the breeding and therefore can make NO assurances that the Puppy will be entirely free
of inherited genetic or other disease, nor that the puppy will meet Buyer’s expectations as respects
conformation, performance, or temperament.  

Health guarantees only apply to Puppies/Dogs that have been bred and raised ourselves. Seller
guarantees the puppy until (1) year of age against any life threatening genetic defects. If your puppy
is diagnosed with a life threatening congenital defect within (1) year from the date of birth, it will be
replaced with another puppy. If your puppy is found to have any life threatening genetic defect, you
must notify us immediately and supply us within (2) business days your Veterinarian's written report.  
We reserve the right to have the diagnosis verified by another Veterinarian of our choice and/or to
require the Buyer to have specific tests run on the puppy to verify the diagnosis before exchange.

All communicable disease' are not covered after your Vet's initial exam. Failure to follow a
Veterinarian's medical advice and vaccination protocol will void this warranty. Buyer understands that
Kennel Cough is very contagious and can be picked up at the Vet's office, on the plane while shipped
or anywhere other dogs and puppies are put together. For this reason, Kennel Cough is not covered
under this warranty.

Seller is in no way responsible if the Puppy/Dog is injured or falls ill during shipping procedure or due
to careless handling of the airlines or courier.  Seller is not responsible for any accident or injury or
condition that occurs after the purchase and will not refund money on an injured puppy or a puppy
that is sick due to the negligence of the buyer.

If this puppy is sold on a Limited Registration the pup must be spayed or neutered by the age of 7
months unless the puppy is not big enough then Breeder will leave it up to the Buyers Veterinarian’s
recommendation.   Pet Quality Registration papers (if given) will be either be retained by the Seller
until proof of Spay or Neuter is sent to the Breeder or will be kept by Breeder.

To the best of Breeder’s knowledge, dog is free of internal and external parasites although we do not
guarantee the puppy to be parasite free. Additional treatments are recommended, if needed.  A copy
of the puppy's health record and veterinary contact information has been/will be provided to the
Buyer. To the best of the Breeder's knowledge, dog is free of genetic or congenital faults, which may
be detrimental to the health and well being of the dog.  

Buyer understands that Yorkie/Biewer puppies/dogs are fragile and require special care to prevent
hypoglycemia and injury due to their size. The smaller the puppy/dog the more care it will need to
prevent illness, such as coughs and infections, stress illnesses and hypoglycemia. Puppies may
dehydrate within a matter of a few hours. Immediate medical attention may be required if your puppy
experiences vomiting or loose stool. Buyer understands tiny dogs often retain puppy teeth and are
more easily susceptible to poisoning from lawn chemicals and plants.  The Buyer shall take the
puppy/dog to a veterinarian for annual health examinations, heart-worm checks and routine
vaccinations.

TYPE OF PUPPY VACCINATION  WE USE:
Proguard 5 Canine Distemper-Adenovirus Type 2-Parainfluenza-Parvovirus vaccine Modified Live
Virus. CPV Strain 154.  

A full rabies shot is 4 times the dose for a full grown Newfoundland. The same shot is given to a 160lb
dog as is given a 2lb dog. It doesn't make sense so please be aware of any reactions that your pup
may exhibit.  DO NOT give rabies, bordatella, lyme vaccines etc. at the same time!  ONE SHOT AT A
TIME… NO EXCEPTIONS!  I DO NOT CARE WHAT YOUR VETS SAY; IT IS TOO MUCH ON A TOY
BREED TO BE OVERDOSED BY TOO MANY VACCINATIONS AT ONCE.  I CANNOT STRESS THIS
ENOUGH!  IF THIS VACCINATION PROTOCOL IS NOT FOLLOWED THIS HEALTH GUARANTEE IS
NULL AND VOID!

If your vet tries to bully you into doing all vaccines at once ask them if they are going to guarantee
you 100% that the puppy is going to be fine after these vaccines and that there is no chance of a
reaction.  Let them know if something happens to the puppy you will hold the Vet responsible and that
if they do not follow breeders vaccination protocol they will be voiding your health guarantee.   

Health Guarantee becomes null and void if all terms and conditions in contract are not
followed!

The Buyer agrees that this puppy is not being purchased for resale and shall be maintained and kept
under the personal control of the Buyer named in this agreement.  The puppy shall be given
adequate housing, food, vet care, and shall in no manner be mistreated, neglected, or allowed to
roam freely.  This puppy is to be kept as a house pet.  
UNDER NO CIRCUMSTANCES WILL THE
BUYER EVER SELL, GIVE, OR TRANSFER THE PUPPY/DOG TO A SHELTER, RESCUE, PUPPY
MILL OR PET STORE.
Seller does not guarantee size or color at adult age.  

If the dog dies within this 1 year time frame, Buyer will pay to have it autopsied to ascertain the
reason.  The Seller must be notified of the problem within two (2) business days of the licensed
veterinarian’s determination reports from two (2) different veterinarians stating the same problem.  
Seller reserves the right to have seller’s veterinarian confirm results before a replacement is given. If
fatal congenital, the Seller will provide a replacement puppy of sellers choice that is of equal value
once available.  Buyer is responsible for shipping costs of the replacement puppy.  There is NO
refund of money.

This Guarantee is valid only for the original buyer and is
non-transferable.  This Guarantee is null
and void if any of the above is caused by abuse, neglect, accident, environment or improper diet
(overweight or lack of nutrition). These steps are to make you aware that I am a caring breeder who is
willing to back up my pups.  It also ensures that I will be notified of any hereditary defects so I can
alter my breeding program if necessary.  


If circumstances become so that the Buyer cannot keep the dog, the Buyer agrees not to place the
dog at any shelter, humane society, or rescue group. If the buyer is unable (at any time in the dogs
lifetime) to provide a suitable home for the dog, the breeder shall be notified.  If possible the breeder
will either take back and keep the dog or re-home the dog for the buyer and any money received,
less any expenses incurred in re-homing the dog (grooming, room and board on a per day basis, vet
care, etc) will be forwarded to the buyer.   The Buyer will not transfer ownership of this dog to anyone
at anytime without the knowledge or consent of the seller.  There will never be a refund of money to
buyer from Seller if the pup/dog has to be sent back no matter when it is.  If the breeder cannot be
reached or cannot take the dog back for any reason, the Buyer agrees to spay/neuter the dog
(assuming the dog is intact) and place in a suitable pet home unless otherwise agreed upon with the
Seller at that time.
             
The Buyer agrees that this puppy is not being purchased for resale and shall be maintained and kept

roam freely.  This puppy is to be kept as a house pet.

PUPPY/DOG TO A SHELTER, RESCUE, PUPPY MILL OR PET STORE.  

No guarantee is made as to disposition, conformation, ability to breed or show, color or
texture of coat.

Buyer will keep Seller informed of significant health, temperament, or behavior problems encountered
throughout the dog’s life.  Buyer will provide pictures and updates of dog’s progress as reasonably
requested.  Buyer will notify Seller in writing of an address change or telephone number or email
change within two (2) weeks of such a change.

The Buyer understands that these toy breeds can be fragile and it is their responsibility to prevent
injuries due to jumping or falling off furniture or other high places, running, or slipping on tiled floors,
or being stepped on while underfoot.

If the Buyer does not follow any condition of this contract, the entire contract shall be void. If this
agreement is not followed then the Seller reserves the right to take possession of said puppy/dog.

Signatures on this contract make this Contract legal and binding. This contract is governed by the
laws of the state of West Virginia and is deemed to be executed and entered into in the State of West
Virginia. Any dispute arising between the parties hereto concerning the meaning or interpretation of
this agreement, or the rights, duties, or obligations of the parties to this agreement shall be submitted
to and determined in Charles Town, West Virginia.  This contract contains the entire agreement
between the parties and no statements or verbal agreements made by either party that are not
contained in this written contract shall be valid or binding.  This contract may not be modified or
altered except in writing.
